Introduction:

Emre İnşaat Otomotiv Pazarlama Sanayi ve Ticaret Limited Şirketi ("Our Company") attaches importance to the privacy and security of your personal data. This text has been prepared to inform and enlighten you within the scope of the Personal Data Protection Law No. 6698.

Information:

The Personal Data Protection Law No. 6698 was adopted on March 24, 2016, and entered into force by being published in the Official Gazette on April 7, 2016. However, according to Article 32 of the Law titled "Entry into Force," the following articles of this Law, namely Articles 8, 9, 11, 13, 14, 15, 16, 17, and 18, entered into force as of October 7, 2016. The purpose of the Law is to protect the fundamental rights and freedoms of individuals, especially the privacy of private life, and to regulate the obligations of natural and legal persons processing personal data and the principles and procedures they must comply with. With this text, visitors are informed and enlightened by our Company. Our Company will process your name, email address, business and home addresses, phone number, and other personal data provided by visitors through the forms on this website only for the purpose of processing and within the limits specified in the consent form and the explicit consent text, if given.

Definitions:

Explicit Consent:

Refers to the consent based on information regarding a specific issue and expressed with free will.

Company:

Cookie:

Contact Person:

A real person declared during registration by the data controller for communication with the Authority regarding the obligations of legal entities resident in Turkey and non-resident legal entity data controllers within the scope of the Law and secondary regulations to be issued based on this Law, and related to the communication between the data controller and the Authority.

(Liability: The contact person is not authorized to represent the Data Controller. As the name suggests, the contact person is appointed only to "contact" the relevant individuals and the Authority regarding the data controller's communication.)

Personal Data:

Any kind of information related to an identified or identifiable real person.

Processing of Personal Data:

Any kind of operation performed on personal data, including obtaining, recording, storing, preserving, altering, reorganizing, disclosing, transferring, taking over, making available, classifying, or using personal data.

Anonymization of Personal Data:

Rendering personal data unable to be associated with a specific or identifiable real person in any way, even if matched with other data.

Deletion of Personal Data:

Making personal data inaccessible and unusable for the relevant users.

Destruction of Personal Data:

Rendering personal data inaccessible, irretrievable, and unusable by anyone.

Board:

Personal Data Protection Board.

Special Qualified Personal Data:

Data related to individuals' race, ethnicity, political opinion, philosophical belief, religion, sect, or other beliefs, appearance, association, foundation or union membership, health, sexual life, criminal conviction and security measures, and biometric and genetic data.

Periodic Destruction:

The process of deleting, destroying, or anonymizing personal data at regular intervals as stipulated in the personal data processing conditions and purposes.

Policy:

Personal data protection policy created by the Company.

Data Processor:

A real or legal person who processes personal data on behalf of the data controller based on the authorization given by the data controller.

Data Recording System:

The record system where personal data is processed according to specific criteria.

Data Subject/Related Person:

The real person whose personal data is processed.

Data Controller:

A real or legal person who determines the purposes and means of processing personal data and is responsible for establishing and managing the data recording system.

Purpose of Processing Your Personal Data:

In case of your visit to our website, your identity, contact, transaction security data will be processed in accordance with the obligations arising from the legislation pursuant to Law No. 5651, keeping electronic log records, conducting information security processes, establishing communication with you and others as part of the business, sending important information about changes in our service terms, changes in our electronic services, and other administrative information, limited to the purposes of conducting activities in compliance with legislation and Company policies and procedures, in accordance with Articles 5 and 6 of the Law. Your personal data may also be transferred to physical archives and information systems and may be kept in both digital and physical environments.

Your Personal Data, as the Data Controller, may be processed by our Company without seeking your explicit consent in the following cases:

a) Explicitly provided for in laws,
b) It is necessary to protect the life or physical integrity of the data subject or another person who is unable to express his/her consent due to actual impossibility or to whom legal validity is not granted for his/her consent,
c) It is necessary for the performance of a contract, provided that it is directly related to the parties to the contract,
d) It is mandatory for the data controller to fulfill its legal obligations,
e) It has been made public by the data subject himself/herself,
f) It is necessary for the establishment, exercise, or protection of a right,
g) It is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

Your Personal Data We Process:

Identity Information:

Your name, surname, Turkish ID number, place and date of birth, nationality information, and other information provided by you with your explicit consent.

Contact Information:

Your residential address, business address, phone number, and email address, your mobile phone number which you have indicated as your preferred contact method for communication with our Company, fax number, or other contact information obtained with your consent for us to reach you.

Work and Education Information:

The application form you filled out for applying to our Company (job application), identity information collected through online or physical application methods provided by our Company, information about your job status, your contact information, and information about your education status ("University graduate, postgraduate" etc.), your past graduation information, information about courses/seminars you attended, your certificate information, and your national or international exam results.

To Whom and for What Purpose Your Processed Personal Data May Be Transferred:

Your collected personal data may be transferred domestically and internationally upon request within the scope of the purposes stated in this Information Text and the legislation related to the Law and for reasons requiring transfer; to law firms and lawyers providing consultancy services, banks where financial activities are conducted, companies acting as the main employer, occupational health and safety companies, financial advisors providing financial services, real persons or private legal entities, business partners, subsidiaries and affiliates, authorized public institutions and organizations, and the systems of companies providing technology services within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of the Law.

Method and Legal Basis of Personal Data Collection:

Your personal data are collected through the communication channels mentioned in this Information Text, such as internet-based application forms, security camera records, and personal data sent to the official e-mail address of our Company, merkez@emreinsaatde.com, and emreinsaatltd@hs01.kep.tr KEP address. Your personal data are also collected by physically sending documents, filling out a document provided by our Company, or by calling the number +90 (312) 276 06 49 or other internal numbers of our Company. Storage, Deletion, Destruction, and Anonymization of Personal Data:

Our Company keeps the personal data it processes for the period prescribed by the Law and legislation or as required by the purpose. Depending on the nature of the personal data, different retention periods may apply, which are prescribed by relevant legislation or necessary for the purpose for which they were processed. If a data has been processed for multiple purposes, when all reasons that require processing of the relevant data have disappeared, the relevant data is deleted, destroyed, or kept anonymous. Personal data processed in accordance with the Law are deleted, destroyed, or anonymized in a way that they will not be used in any way and will not be retrieved when the reasons requiring processing cease, ex officio or upon request of the data subject.

Our Company has established necessary systems and audit mechanisms for the deletion, destruction, and anonymization of personal data. The storage and destruction procedure prepared by our Company is implemented.

Rights Listed in Article 11 of the KVKK for the Data Subject:

In accordance with Article 11 of the Law, everyone has the right to apply to the data controller regarding the personal data concerning themselves;

a) To learn whether personal data is processed,
b) To request information if personal data has been processed,
c) To learn the purpose of processing personal data and whether they are used in accordance with the purpose,
d) To know the third parties to whom personal data are transferred domestically or abroad,
e) To request correction of personal data if it is incomplete or incorrectly processed,
f) To request deletion or destruction of personal data within the framework of the conditions stipulated in Article 7 of the Law,
g) To request notification of the operations carried out as a result of correction or deletion of personal data to third parties to whom personal data have been transferred, in accordance with subparagraphs (d) and (e),
h) To object to the occurrence of a result against the person himself/herself

If you submit your request to our Company using one of the methods shown above, your applications will be examined, evaluated, and concluded within the shortest time and no later than 30 (thirty) days. Although no fee is charged for requests as a principle, our Company reserves the right to charge a fee based on the fee schedule determined by the Personal Data Protection Board.
